TERMS FOR EXPRESSION OF INTEREST IN PARTICIPATING IN iMEdD’S BRIDGE PROGRAMME/PILLAR
iMEdD is a non-profit company founded in 2018 with an exclusive donation from the Stavros Niarchos Foundation. Its mission is, inter alia, to interactively create conditions for the development and synthesis of new ideas and best practices, aiming mainly to promote and reinforce transparency, validity and independence in journalism, with a primary focus on meritocracy and excellence.
Its goal is also to create a modern journalism nucleus and a strong community of independent media professionals within a welcoming space that promotes collaborations and the development of ideas and new ventures, assisted by the latest technology.
The organisation adheres to international standards and collaborates with the Greek and international academic community, other relevant international bodies, and professionals from around the world.
One of iMEdD’s pillars is Bridge.
The Bridge pillar/programme
iMEdD Bridge collaborates with initiatives from Greece and abroad that address social issues through journalism. Journalism is utilised as both a means of expression and a vehicle of democracy for population groups that do not have direct access to information sources.
1. General Framework for participation
Having regard to the above, by completing this application for the expression of interest in participating in the iMEdD Bridge programme, hereinafter referred to as “Participation application”, and submitting it electronically to the non-profit company iMEdD, the candidate participant expressly declares that they have been informed of, accept and consent to the following:
1.1. They embrace iMΕdD’s goals and objectives.
1.2. They support the promotion of journalistic best practices and values.
1.3. They wish to participate in the Bridge pillar/programme in order to contribute to the accomplishment of iMΕdD’s overall goals and the particular goals of the programme/pillar.
2. Prospective Participant’s Obligations
The candidate Participant undertakes the following commitments, inter alia, toward iMΕdD:
2.1. The entirety of the information outlined in the participation application is absolutely valid and true. In the event of any change until the end of processing and assessment of the candidature, they undertake to inform iMΕdD immediately.
2.2. To treat as strictly confidential the information that comes to their knowledge, along with the content of any meetings and, in general, contact with iMΕdD that will take place during the candidature processing and assessment stage, unless expressly agree otherwise.
2.3. The idea for the proposed Project is the intellectual property of the participant themselves and they are the sole legal owner of all intellectual property rights related to it, or in any event they have received permission from their legal owner, in advance, to use said rights, while the participant is solely responsible for any relevant infringement and the penalties/liabilities/compensations arising therefrom. In the event that the Project proposed or the idea upon which it is based is the intellectual property of more persons, the other persons and their contact details must also be stated in the application. In the event of infringement of the intellectual property rights of third parties by the candidate participant, the sole culprit is the latter, while iMΕdD disclaims any responsibility. In such a case, iMΕdD is entitled to claim compensation against the candidate participant, either directly, or via derivative action, or via action for recovery.
2.4. All material mentioned in or attached to the candidature does not infringe intellectual property rights of third parties, and in any event the candidate participant has received prior permission from its legal owner to use said intellectual property, while the participant is solely responsible for any relevant infringement and the penalties/liabilities/compensations arising therefrom.
3. iMEdD’s duty of Secrecy and Confidentiality
iMEdD undertakes the following commitments toward the candidate participants who submit electronically this application for participation in the Bridge programme/pillar:
3.1. To treat the entirety of the content (candidate’s data, their vision, mission and goals, their team members, ideas related to the project proposed, information, etc.) of each candidature with strict secrecy and confidentiality.
3.2. To use and process in any way the information disclosed to it through the submission of the candidature exclusively for the purpose of assessing the candidature.
3.3. To disclose the candidature content only to its personnel, its agents or other third parties that are under its control and strictly necessary for the processing and assessment of the candidature.
3.4. To take all measures necessary so that the same secrecy and confidentiality is adhered to by its agents or other third parties. To this end, iMEdD has already informed its agents in advance and they have committed themselves through a relevant Secrecy and Confidentiality agreement, while in the event that third parties are involved (e.g. members of an independent assessment committee), it commits to act accordingly.
3.5. Not to use the candidature content in any way that will result in an economic advantage for iMEdD, or the agents, or thirds parties.
3.6. To keep the candidature content and any accompanying documents thereof, in any form they may be in (e.g. documents, electronic files, etc.), under secure conditions.
3.7. Following the completion of the process of assessing each candidature, iMEdD is entitled to store, purely for archival purposes, the material provided by the candidates, provided that this is permitted by law and subject to any conditions and limitations thereof. In the event that for any reason a candidate does not want a record to be kept by iMEdD, and provided that they inform the latter in writing, iMEdD is required to either return the material immediately, or destroy it in its entirety, including any back-up copies created.
4. Intellectual Property Rights
The intellectual property rights of the candidates/participants are protected under the relevant provisions of Greek law, European law and international conventions. Even after the final submission of the participation application, each candidate participant retains the right to exploit their idea and material commercially all over the world, throughout the various stages of the programme, without any temporal, geographical or other limitations, including but not limited to: the license to use, copy, record, distribute, reproduce, disclose, sell, resell, transfer to a third party, portray, publicly perform, transmit, publish, broadcast, translate, upload, create derivative works, and other types of usage and exploitation in any way of the entirety or part of the show, appearance, data, personal information, photographs or other elements created by the Participant and submitted to, transferred to or shared otherwise with iMEdD, for any purpose and in any form, using any method or medium available today or developed in the future and with any technology or devices available today or developed in the future, and to advertise, use commercially and market said idea/material, unless expressly agreed otherwise. Furthermore, they reserve the right to assign said rights (entirely or partially) to any third party, with or without financial remuneration, and without any temporal, geographical or other limitation.
5. Personal Data
5.1. iMEdD informs the prospective participant in the Bridge programme/pillar that it collects and processes certain personal data that are absolutely necessary for the processing and assessment of their candidature.
5.2. The term “personal data” refers to information related to natural persons, private individuals and professionals, such as name, postal address, IP address, contact number, etc., that can be used to identify the candidate/participant, and shall be hereinafter referred to as “Personal Data or Data”.
5.3. “Personal Data Processing” means the collection, recording, organisation, storage, adjustment, modification, retrieval, search for information, usage, transmission to third parties, dissemination, correlation, combination, limitation, erasure and destruction of Personal Data of natural persons.
5.4. Upon completion of the special application form and its final submission, iMEdD collects various information, such as name, surname, mother’s name, father’s name, postal address, telephone number and email. Collection of said data takes place solely for the purposes of the services provided via https://www.imedd.org, and particularly for a) communicating with the candidate using the information provided through the participation application, b) complying with the requirements imposed by the applicable legislation, c) sending newsletters, and d) processing and assessing the candidature.
5.5. Recipients of these Data are the absolutely necessary iMEdD personnel who are bound by confidentiality. Furthermore, the candidate participant’s Data may be disclosed to third parties if it is expressly requested by themselves or required by law.
5.6. iMEdD may process the candidate participant’s personal data to inform them of its activities only if it has obtained their express consent or if it considers that an overriding legitimate interest to do so exists. The candidate/participant has the right to object at any time to the processing of their personal data for marketing and information purposes, as well as to withdraw their consent to this effect.
5.7. iMEdD shall process and store the candidate participant’s data throughout the application processing and assessment, and for as long as is necessary for the fulfilment of its contractual and legal obligations. The processing of the Data in any way shall be performed exclusively by authorised individuals, employees and partners, solely for the purposes stated above.
5.8. The candidate participant’s personal data shall be erased when they are no longer necessary for the purposes for which they were collected and processed, following a request or objection to their processing by the data subject – provided that no legal obligations exist that require their further retention, when they are not necessary for purposes of iMEdD’s compliance with legal obligations or upon the withdrawal of the subject’s consent (if the data collection and processing was based on it).
5.9. iMEdD is committed to safeguarding the Personal Data of the candidate participant. To this end, it employs and makes use of trained and competent personnel engaged in this field. At the same time, it has taken appropriate organisational and technical measures for protecting the Data from any form of accidental or unlawful processing. Furthermore, it possesses and applies appropriate security policies and uses the appropriate organisational and technical/operational tools, such as (including but not limited to) anonymisation, pseudonymisation, data encryption, use of firewalls, establishing authorised access levels, processing by specifically authorised employees, personnel training, periodic inspections. All the above measures and security policies are reviewed, amended and updated as necessary.
5.10. iMEdD does not collect or require the disclosure of sensitive personal data (special category data) through https://www.imedd.org for the needs of the programme in question.
5.11. As a personal data subject, the candidate participant has the following rights:
a. Right of access, i.e. the right to view or receive a copy of the personal data held on their behalf and to check that they are processed lawfully. To receive a copy, they may contact iMEdD using the contact details provided on its website.
b. Right to rectification, i.e. the right to request rectification of the personal data held for them that may be incomplete or inaccurate.
c. Right to erasure, i.e. the right to request the erasure of their personal information (“right to be forgotten”).
d. Right to object, i.e. the right to object to the processing of their personal data.
e. Right to restrict processing, i.e. the right to request restriction of the processing of their personal data when the data is inaccurate, the processing is unlawful, or they do not need to be held for the purposes for which they were collected.
f. Right to portability, i.e. the right to receive a copy of their personal data in a structured, commonly used and machine-readable format, and to transmit said data to other organisations, and to request that they are transmitted directly to other designated organisations.
g. Right to revoke at any time the consent granted regarding the processing of personal data. Any revocation of consent does not affect the lawfulness of the processing based on consent (prior to its withdrawal or revocation); however, it may result in the termination of some services or collaboration.
To exercise any of the above rights the candidate participant can contact iMEdD at3A Stadiou St., 10562, Athens, Greeceor at info@imedd.org. They also have the right to file a complaint with the Data Protection Authority (postal address 1-3 Kifisias Av., Postal Code 115 23, Athens, tel. no. 210 6475600, email [email protected]) if they consider that the processing of their Personal Data violates the applicable national legislation on protection of personal data.
5.12 The candidate participant states expressly that they consent to the collection and processing of their personal data as per the above.
6 More Specific Participation Terms
6.1 iMEdD reserves the right to modify at any time, in whole or in part, the content of the Bridge pillar/programme and the terms of participation, while the candidate participant shall waive any claims arising, directly or indirectly, from said modifications.
6.2 Candidatures that are not clear and concrete shall not be taken into consideration.
6.3 If during the examination and assessment of the candidature iMEdD considers that there has been a violation of the participation terms herein, as and if they have been configured, or the laws and accepted principles, or the general principles of journalism, or the relevant domestic and international ethical standards, or if there is any conflict with its goals and operating principles, it reserves the right to reject or not to examine and assess the candidature.
6.4 iMEdD reserves the right not to respond to the interested candidate participant.
6.5 The candidate participant recognises and states that no financial obligation or claim against iMEdD arises by submitting this candidature and any accompanying documents thereof.
6.6 iMEdD is not responsible or liable for any direct or indirect loss or damage suffered by the Candidate Participant, whether financial, consequential or of any other type, that is related directly or indirectly to the candidature.
6.7. In the event that any disagreement or dispute arises regarding the candidature submission and processing, the Parties shall make every effort to resolve it through amicable and out-of-court consultation. If amicable consultation is not possible, the Courts of Athens in Greece are designated as the sole competent authority to settle the dispute and Greek law is designated as the only applicable one.
